Notice to All Patrons and Private Cellar Members
By browsing, creating an account, or acquiring vitolas and accoutrements from Cigar Lounge (“we”, “us”, or “the Lounge”), you enter into a legally binding contract governed by these Terms & Conditions. If you do not accept these provisions in their entirety, you must abstain from purchasing.
1. Age Verification & Legal Tobacco Eligibility
The purchase, handling, and possession of premium cigars and pipe tobacco is strictly restricted to adults of legal smoking age. In compliance with the federal Tobacco 21 statutes in the United States and international equivalents, you must be at least twenty-one (21) years of age (or the legal threshold of majority in your jurisdiction, whichever is greater).
- Automated Third-Party Verification: All initial transactions are subject to instantaneous verification via accredited age-validation databases utilizing government-issued identification records.
- Adult Signature Required Upon Delivery: All parcels containing tobacco products require the physical signature of an adult (21+) with photo ID at the time of delivery. We do not dispatch to post office boxes or automated parcel lockers.
- Zero Tolerance: Attempts by minors to order or falsify identification will result in immediate cancellation, forfeiture of restocking fees, and reporting to relevant jurisdictional authorities.
2. Orders, Allotments & Currency Settlement
All listings on Cigar Lounge represent invitations to treat and do not constitute unilateral offers. An order is confirmed solely when credit verification is fulfilled and a formal Cellar Dispatch confirmation with tracking credentials is generated.
- Pricing & Tariffs: All prices are displayed in USD ($) and exclude local state excise taxes, import duties, or value-added tariffs which remain the buyer's responsibility upon cross-border transit.
- Allocation Limits: To preserve collector equity, Limited Edition, Vault Reserves, and Vintage Cuban vitolas are subject to maximum order quantities per client account. We reserve the unilateral right to curtail or cancel bulk broker acquisitions.
- Payment Security: Transactions are processed via 256-bit encrypted merchant gateways. We do not store unmasked card credentials on our servers.
3. Specialized Packaging & Boveda Humidity Assurance
Unlike conventional retail deliveries, luxury cigars require uninterrupted climate governance. Every consignment dispatched from our vaults is sealed inside airtight barrier packaging accompanied by genuine Boveda 69% relative humidity packs and lined with aromatic Spanish cedar veneer.
4. Inspection, Damaged Goods & Return Protocols
Due to the perishable and consumable nature of premium fermented leaf, cigars cannot be returned once the factory seals or airtight cellophane envelopes have been opened, cut, or ignited.
- Transit Damage Claims: If a package arrives with visible crushing, mold contamination, or wrapper fractures, patrons must notify our Sommelier Concierge within forty-eight (48) hours of delivery with clear photographs.
- Remediation: Upon validation, Cigar Lounge will immediately dispatch a priority replacement parcel or issue full cellar credits to your account.
- Accoutrements & Humidors: Non-tobacco hardware (cutters, lighters, desktop humidors) may be returned within thirty (30) days in pristine, unused original packaging.
5. Digital Allocations, Member Vault & Masterclasses
Purchases of the Private Sommelier Tasting Pass or Geneva Subterranean Allocation Tiers grant non-transferable service rights. Masterclass appointments must be rescheduled at least seventy-two (72) hours in advance of the scheduled video tasting session to permit routing of pairing flight vitolas.
6. Handcrafted Variances & Health Disclaimers
Every premium cigar is hand-rolled from organic, sun-cured agricultural leaf. Natural variations in wrapper shading (maduro, claro, rosado), toothiness, draw resistance, and burn speed are inherent marks of artisanal authenticity rather than defects.
7. Intellectual Property & Brand Trademarks
All trademarks, vitola imagery, sommelier tasting matrices, editorial notes, and website design elements are the exclusive intellectual property of Cigar Lounge or used under legitimate distributor authorization. Reproduction without prior written permission is strictly prohibited.
8. Governing Law & Concierge Contact
These terms are governed in accordance with the substantive laws applicable to licensed tobacco merchants, excluding conflict of laws doctrines. Any unresolved dispute arising under these terms shall be settled via binding individual arbitration.
